These terms govern the sale of the Caviste gift card on cavisteapp.com. They do not apply to subscriptions taken out inside the app, which are governed by the terms of Apple's App Store or of Google Play, the only parties that collect payment for them.
Placing an order means accepting these terms, in the version in force on the day of the order.
Caviste is published by Alexandre Rabottin, sole trader (entrepreneur individuel), registered under SIRET number 840 085 195 00013, whose registered address is 4 allée Richemont, 44000 Nantes, France.
Contact: contact@cavisteapp.com. This is the address to use for any question, complaint or refund request; it is read by the publisher himself.
VAT not applicable, article 293 B of the French General Tax Code. Prices are therefore free of tax.
The gift card grants twelve months of Premium access to the Caviste app, for the person it is intended for. What Premium access covers is described on the gift card page and may evolve with the app, without ever being reduced below what it covered on the day of purchase.
The price is 24.99 € including all taxes, shown on the sales page and restated before payment. The card gives no right to the delivery of any physical goods, and in particular to no bottle of wine.
The order is placed on a payment page hosted by Stripe Payments Europe, Ltd., which processes the transaction. The publisher neither sees nor stores any bank card details.
At payment, the buyer provides the email address of the person they are giving the card to. That address is the only piece of information that drives delivery: it must be correct.
The order is firm as soon as payment is collected. Stripe sends a receipt to the buyer's email address.
The card is delivered by email, to the recipient's address given with the order, within one working day of payment being collected. That email contains what to do and the reference of the card.
Buyers who wish to hand over the gift themselves may give their own email address at payment: they will receive the card and can pass it on whenever they want. An unclaimed card does not expire.
If nothing arrives, the buyer writes to contact@cavisteapp.com: the card is sent again, with no further payment.
The recipient activates the card by creating a Caviste account with the email address the card was sent to. Premium access then opens automatically, with no code to enter. If the recipient already has an account with that address, access opens on that account.
The twelve months run from activation, not from purchase. Two cards received by the same person are added to one another.
At the end of the twelve months, no payment is taken and no subscription starts: the account returns to the free tier, with the cellar data and the tasting journal kept intact.
The recipient remains free to take out a subscription in the app afterwards. That subscription is a contract separate from this sale, entered into and collected by Apple's App Store or by Google Play depending on the device, and cancelled with them.
An account created with an address other than the gift's will not see the card. Writing to contact@cavisteapp.com is enough to move it to the right account.
The buyer has fourteen days from purchase to withdraw, without having to give a reason and without penalty.
To exercise it, it is enough to write to contact@cavisteapp.com, in plain words or using the form reproduced below. The refund is made by the same means of payment as the purchase, at the latest fourteen days after the request is received.
One exception, provided for by article L221-28 of the French Consumer Code: if the recipient has already activated the card, the service has begun to be supplied with the buyer's agreement and the right of withdrawal no longer applies. As long as the card is not activated, it applies in full.

Caviste gift card ordered on [date], under reference [card or payment reference].

Any complaint goes to contact@cavisteapp.com. The consumer benefits from the legal guarantee of conformity (articles L217-1 and following of the French Consumer Code): if Premium access does not work, it is restored or refunded.
The email addresses of the buyer and of the recipient are used only to deliver the card, to activate it and to answer a complaint. They are neither sold on nor used for marketing. The detail of the processing is set out in the privacy policy.
These terms are governed by French law. Consumers resident in the European Union keep the protection of the mandatory rules of the law of their country of residence. In the event of a dispute, the buyer may bring the matter before any court that has territorial jurisdiction.
